Please read the following information carefully before finalizing the creation of your user account. This information serves as a contract between the “Seller”, the “Buyer” and the “Website”.
If you agree with the process, please accept these conditions by checking the box reserved for this purpose.
A “Seller” is defined as a person who offers their clothing and fashion accessories for sale via the www.bonmagasinage.com platform.
The “Buyer” is defined as the person who purchases fashion clothing and accessories for sale via the www.bonmagasinage.com platform.
The “Site” or the “Platform” or “Bon Magasinage”, “we” is defined: www.bonmagasinage.com, the platform for announcing these exchanges (brings the “Seller” and the “Buyer” together).
Is defined by “Delivery method”: the means of delivering the item ordered on Bon Magasinage.
Is defined by “Catalog”: all the advertisements published by Bon Magasinage sellers.

Concept
Bon Magasinage in a few words :
The wonderful team at Bon Magasinage has always been adept at exchanging and reselling clothing. The Bonmagasinage.com Website was born from the desire to create a Canadian community for the sale of second-hand clothing and to facilitate exchanges by centralizing offers and requests within the same platform. Bonmagasinage.com acts as an intermediary between Sellers and Buyers.
Account creation:
Whether you are a buyer or a seller, you can create an account on Bon Magasinage. This will allow you to shop our entire catalog at your leisure and sell items from your wardrobe that you no longer wear. Creating an account is completely free. Fees apply only to sales. In the case of a sale, e-mail notification is mandatory and automatically activated. Text message notification can also be added to the customer account settings.
Images and photos shared s
Images and photos imported, published and shared via ad creation must be free of copyright and/or belong to Bon Magasinage members who publish them. Bon Magasinage reserves the right to relay these images on its social networks in order to highlight its members’ ads and promote the sale of their products. By importing these photos when creating an ad, the Bon Magasinage member agrees that Bon Magasinage may use these photos to relay them on these social networks.
Deleting ads :
It is the responsibility of the seller to sell items in the condition in which they are found. Bon Magasinage cannot be held responsible for the misinformation of an item.
Bon Magasinage reserves the right to delete any ad with inappropriate content or that does not comply with the Good Seller Charter. If we feel that an item for sale is too damaged, has holes or stains, we will remove it from the catalog. Similarly, if the ad does not comply with Bon Magasinage’s aesthetic guidelines (wrong format, text on the photo, etc.), Bon Magasinage reserves the right to delete or deactivate the ad immediately.
Respecting the Bon Magasinage platform and not circumventing the platform :
Please note that Bon Magasinage is the owner of the platform. Bon Magasinage reserves the right to ban any member who is suspected of not respecting/contracting or using the Bon Magasinage platform in a manner contrary to the objectives of this code of conduct. It is therefore not in your interest not to be charged the Good Shopping commission (20% + Tx).
Bon Magasinage cannot be held responsible for any dispute arising from a transaction carried out outside the platform. To help us exist and to protect you, it is essential to carry out your transactions on the Bon Magasinage platform.
Brand new and beautiful!
Bon Magasinage has given itself a facelift, and the new site has been online since April 2024. The migration to this new platform involves creating a new password when you log in to Bon Magasinage for the first time.
What happens to existing Bon Magasinage accounts prior to platform migration?
The first time you log on to our new Website (whose address remains identical to Bonmagasinage.com), you will be able to use your account again, thanks to the e-mail address you used to create your Bon Magasinage account.
Here are the details of what has been retained in the migration to this new Website: sales and purchase history, favorite items and members, and public comments.
Here are the details of what has not been preserved in the migration of this new platform: passwords (this is why a new password must be created when you first connect to this new Website). Bank details (even partial ones) and credit card information are not stored.
Financial transactions and payments
Payments and financial transactions :
Bon Magasinage brings together Sellers and Buyers wishing to sell fashion items (clothing or accessories), both new and second-hand. When a user buys a product, the payment is automatically debited according to the chosen payment system: credit card ( Stripe, Google Pay, Apple pay).
Commission Bon Magasinage = 20% + Tx payable by seller :
In order for Bon Magasinage to make its services profitable and continue to develop its platform in due form, a commission of 20% + Tx (GST 5% / QST 9.975% on the commission amount) is deducted from each sale made on Bonmagasinage.com. This commission is deducted directly from the money received by the Seller. This commission is not a fixed percentage and may vary over time. If this happens, an e-mail will be sent to all Bon Magasinage members. For example: If you sell an item for $30, the amount deposited in your account will be $23.12. Bon Magasinage’s commission is $6 plus $0.89 government tax, for a total of $6.89.
New ✨ $1.50 withdrawal fee payable by seller
New since April 2024 and the update of the Bonmagasinage.com platform, each Bon Magasinage seller now has access to a virtual Wallet in which the money from their sales is deposited. It is up to each seller to decide whether he/she wishes to re-spend the money from his/her sales on Bonmagasinage.com or have the money transferred to his/her bank account. Each transfer request will incur a $1.50 fee, directly deducted from the amount to be transferred.
Disputes
In the event of a dispute with a third party or with Bon Magasinage :
We will make every reasonable effort to settle any dispute fairly. In the event of a dispute between Seller and Buyer, Bon Magasinage cannot be held responsible but will do its best to help resolve the conflict.
Postal delivery
Postal delivery via Canada Post:
All sellers who register with Bon Magasinage must have (or have access to) a printer to print the postal label. Delivery with Canada Post is possible on Bon Magasinage and, since April 2024, the rate is calculated according to the size and weight of the parcel and the address of the Seller and Buyer.
When a buyer selects postal delivery for his order, the seller is informed and can create his own postal label from his “My sales” dashboard. The seller will have to print the mailing label himself, stick it on his envelope and drop the package in any P.O. box. Any seller who makes a sale with “Postal Delivery” is obliged to honour that order. The mailing label has already been paid for, but the envelope in which he will wrap his package is at his own expense.
Final sales policies
No returns or refunds are possible on Bon Magasinage. If an item is not suitable when you receive it, you are free to re-sell it directly on Bon Magasinage.
The prices displayed on Bon Magasinage are defined by the Sellers. If you’re a Seller and you’re in doubt about what price to set on your item, you can contact a member of our team at allo@bonmagasinage.com, and we’ll help you come up with the best offer for your item. Bon Magasinage can in no way be held responsible for the non-sale of an item or for the ineffectiveness of the advertisement posted by the Seller.
The price of an item sold on Bon Magasinage is final and cannot be modified once the transaction has been completed. In other words, a seller cannot change the price of the item sold after the transaction has taken place. If a seller and / or buyer wishes to apply and / or request a discount on a purchase, Bon Magasinage cannot be required to apply this discount on the starting price nor on its commission taken.
In the rare event that a Seller is unable to honour a sale, payment will be refunded to the Buyer. In order to guarantee a reliable community of sellers, any cancellation of a sale will result in a drop in the percentage of sales honored by a Seller, as well as a drop in their star rating visible on their Bon Magasinage public profile.
Privacy
Bon Magasinage Mailbox: Messages exchanged on the Bon Magasinage mailbox can be viewed and moderated by the Bon Magasinage team.
Closing an account :
If you wish to permanently close your Bon Magasinage account, please contact a member of our team at allo@bonmagasinage.com. If, when you close your account, you owe money to Bon Magasinage or to a Seller on the platform, you will be held responsible. Closing your account will not cancel your debt, and legal action may be taken to honour it. For legal and tax reasons, Bon Magasinage must keep all proof of transactions (sales and purchases) made with your account. Bon Magasinage will therefore need to retain some information and will not be able to delete all account data.
Your personal and confidential information :
Some personal information (address, last name, first name) may be shared between Sellers, Buyers and Bon Magasinage staff depending on the options you have chosen (e.g. postal delivery). We do not share this information outside the context of the sale.
Intellectual property
Content and intellectual property :
The system/service devised by Bon Magasinage Inc. and all its contents, including but not limited to all text, images, descriptions, graphics and code belong to Bon Magasinage Inc. and are protected by copyright, trademark, database and other intellectual property rights. You may copy, paste, share and download Bon Magasinage content as long as it is for personal, non-commercial use. Any other use of this content must be authorized by us. Without this authorization, any use of this content is strictly prohibited.
Limitation of liability and prohibited content
Prohibited content:
It is forbidden to publish on Bon Magasinage photos/videos or words containing/mentioning drugs, cigarettes, alcohol, weapons, pornographic content, obscene offensive or any other content deemed inappropriate by Bon Magasinage. If any such content is visible on Bon Magasinage, it will be automatically and immediately deleted without notice. Only the seller of these items will be held responsible for these facts, and will have to answer to the Canadian authorities if requested to do so.
Consistency of ads :
Bon Magasinage reserves the right to remove an ad if the content does not correspond to Bon Magasinage’s desired aesthetic.
Counterfeit or stolen goods :
You may not sell stolen or counterfeit items on Bon Magasinage. Bon Magasinage cannot be held responsible for the publication of this content. If we have any doubts about the provenance of the items offered for sale, we will contact the sellers to obtain more details or photos of the item. Bon Magasinage reserves the right to suspend any publication about which Bon Magasinage has doubts. The seller alone is responsible for his items and will be held liable before the authorities.
Prohibition on selling items for commercial use:
Only private individuals can sell on Bon Magasinage. If you are a retailer, it is not possible to sell on Bon Magasinage. All items offered for sale on Bon Magasinage must be offered for sale by private individuals. If items are found to be for sale for commercial purposes, Bon Magasinage will automatically remove them and legal action may be taken.
Bon Magasinage reserves the right to suspend the Vendor’s account without notice should Bon Magasinage become aware that the aforementioned principles have not been respected or applied.
Limitation of Liability: Bon Magasinage offers a listing service and charges sellers a commission for this service.
Bon Magasinage cannot be held responsible for any defect or inaccuracy in the description of a garment or fashion accessory. It is the seller’s responsibility to accurately state the condition of the item for sale. In the event of a dispute that cannot be definitively resolved by Bon Magasinage mediation, the Buyer and the Seller are free to sue each other directly.
Bon Magasinage cannot be held responsible if one of its Sellers or Buyers is called into question for any reason whatsoever or if they have failed to respect any act that is in their best interest.
Bon Magasinage cannot be held responsible for the unavailability of an item. Delivery charges, if this option has been selected by the Buyer, are the Buyer’s responsibility. Under no circumstances can delivery charges be cancelled or refunded.
Bon Magasinage cannot be held responsible for any dispute between the Seller, the Buyer and Stripe. However, Bon Magasinage will always be there for you, and our team will do everything in its power to help you with any problems you may have.
General
Should a court of law render any provision of the present contract null and void, the remaining provisions shall remain in force. Any clause found to be illegal by a court of law will be replaced by a legal clause as close as possible to the illegal clause.
