1. Definitions

In these General Terms and Conditions of Sale (GTC), the following terms are defined as follows:

  • “Seller”: any member who lists fashion items for sale on the Bon Magasinage platform, whether an individual or an authorized professional.
  • “Buyer”: any member who makes a purchase through the Bon Magasinage platform.
  • “Member”: any person holding a Bon Magasinage account, whether as a Seller, Buyer, or both.
  • “Platform” or “Site” or “Bon Magasinage”: the website www.bonmagasinage.com and its associated services.
  • “Catalogue”: the full collection of listings published by Sellers on the platform.
  • “Bon Magasinage Seller Charter”: the document complementary to these GTC, detailing the specific commitments expected of Sellers.

2. About Bon Magasinage

Bon Magasinage is a Quebec-based platform for buying and selling second-hand clothing and fashion accessories, built on the values of quality, trust, and desirability. Bon Magasinage acts as an intermediary between Sellers and Buyers, and does not own any of the items listed on the platform.

3. Account Creation and Membership Conditions

3.1 General Conditions

Account creation is free and open to any adult individual residing in Canada, as well as to authorized professional sellers (thrift stores, charity shops, and second-hand retailers). By creating an account, the member agrees to these GTC as well as the Bon Magasinage Seller Charter (for Sellers).

Professional sellers wishing to register on the platform are invited to contact the Bon Magasinage team at allo@bonmagasinage.com to confirm their eligibility and the specific conditions applicable to their situation.

3.2 Notifications

Email notification is mandatory and enabled by default for every sale. SMS notifications for sales can be activated in account settings.

3.3 Account Suspension and Deletion

Bon Magasinage reserves the right to suspend or delete any account in the event of a breach of these GTC or the Bon Magasinage Seller Charter, including but not limited to:

  • Listing counterfeit or stolen items
  • Bypassing the platform to conduct transactions outside of Bon Magasinage
  • Disrespectful behaviour toward other members or the Bon Magasinage team
  • Publishing content that is inappropriate or contrary to these GTC

In the event of a detected breach, Bon Magasinage will notify the member by email, unless the severity of the breach requires immediate action. The member may contact allo@bonmagasinage.com for any explanation.

4. Images and Photos

Photos uploaded to the platform must be rights-free and belong to the member publishing them.

To ensure Buyer confidence, each listing must include at least three personal photos of the actual item, taken by the Seller (front, back, size and composition label). Additional photos generated by artificial intelligence or sourced elsewhere may be added as a complement, but cannot be the sole visuals of a listing.

By uploading photos to Bon Magasinage, the member authorizes Bon Magasinage to share them on its social media channels to promote listings and encourage sales. This authorization is valid for the duration of the listing.

5. Listings and Catalogue Management

5.1 Publishing a Listing

Every Seller commits to describing their items accurately, including the real condition of the piece, any flaws, and all information relevant to the Buyer. Bon Magasinage cannot be held responsible for inaccurate descriptions provided by a Seller.

Indicating the origin of the item is mandatory for every listing published on Bon Magasinage. The Seller must specify, as applicable:

  • The brand of the item, as it appears on the label
  • The mention “vintage” if the item is old and no longer has its original label
  • The mention “handmade” if the item was made by the Seller or an artisan
  • The mention “no label” if the label is missing and the item is neither vintage nor handmade

As part of our commitment to fighting fraud and maintaining Buyer trust, Bon Magasinage reserves the right to remove any listing whose label is missing and whose origin cannot be clearly established. The Seller concerned may be contacted to provide additional information before any final decision is made.

5.2 Prohibition of Ultra Fast Fashion Items

As part of its commitment to quality, sustainable, and desirable fashion, Bon Magasinage has made the decision to prohibit the listing of items from ultra fast fashion brands on the platform. This decision reflects our core values: promoting pieces that last, that carry meaning, and that deserve a second life.

A brand is considered ultra fast fashion if it meets the majority of the following criteria, as defined by the independent organization Good On You (goodonyou.eco), an internationally recognized reference for ethical fashion:

  • Very frequent collection turnover (several times per week)
  • Abnormally low prices that do not reflect the real cost of production
  • Poor manufacturing quality resulting in a very short product lifespan
  • Lack of transparency regarding production conditions and supply chain
  • Documented and concerning environmental and social impact

The following brands are notably concerned: Shein, Temu, Fashion Nova, PrettyLittleThing, Boohoo, Nasty Gal, Zaful, Romwe, and AliExpress Fashion. This list is not exhaustive and may be updated by Bon Magasinage.

Any listing identified as coming from these brands will be removed from the catalogue. In the event of repeated violations, Bon Magasinage reserves the right to suspend the account in question.

5.3 Luxury Items and Authenticity

Bon Magasinage pays particular attention to the authenticity of luxury items listed on the platform.

As a first measure, Bon Magasinage reserves the right to remove without notice any luxury item that appears to be counterfeit or whose authenticity cannot be reasonably established (absence of photos of the hardware, label, proof of purchase, or any other supporting evidence). The Seller concerned may be contacted to provide additional proof.

As a second measure, Bon Magasinage will establish a partnership with a trusted third-party specialized in luxury item authentication. Certified items will benefit from a trust badge visible on their listing. The details of this service will be communicated to members upon its launch.

5.4 Listing Removal

Bon Magasinage reserves the right to remove or deactivate, without prior notice, any listing that:

  • Features an item that is stained, torn, shrunken, or significantly damaged without this being disclosed in the description
  • Does not meet the platform’s aesthetic standards (poor photo quality, text on photos, incorrect format)
  • Does not include a personal photo of the actual item
  • Contains content that is inappropriate or contrary to these GTC
  • Features a counterfeit or stolen item

6. Financial Transactions and Payments

6.1 Payment Process

When a Buyer completes an order, payment is immediately charged via the accepted payment methods on the platform: bank card and payment link.

6.2 Bon Magasinage Commission

A commission of 20% plus applicable taxes (GST 5% / QST 9.975% on the commission amount) is deducted from each sale made through the platform. This commission is deducted directly from the amount received by the Seller.

Example: For an item sold at $30, the Seller receives $23.12. The $6 commission plus $0.89 in taxes totals $6.89 deducted.

Bon Magasinage reserves the right to modify this commission rate. In the event of a change, an email will be sent to all registered members at least 30 days before the new rate comes into effect.

6.3 Virtual Wallet and Transfers

Sale proceeds are credited to the Seller’s virtual wallet, accessible from their dashboard. The Seller may choose to reinvest these funds on the platform or request a bank transfer.

Each transfer request incurs a $1.50 fee, deducted directly from the amount to be transferred.

6.4 Identity Verification (KYC)

Seller payments are processed through our partner Wise. As part of anti-fraud and anti-money laundering measures, Wise may require Sellers to provide a valid government-issued ID, a selfie or biometric verification, and additional information (address, date of birth). These verifications are independent of Bon Magasinage and are required by regulatory authorities. Bon Magasinage does not have access to the documents submitted to Wise.

6.5 Platform Compliance

All transactions must be conducted through the Bon Magasinage platform. Any circumvention of the platform, particularly to avoid the commission, is prohibited and may result in immediate account suspension. Bon Magasinage cannot be held responsible for any dispute arising from transactions conducted outside the platform.

7. Shipping

Every Seller registered on Bon Magasinage agrees to offer postal shipping via Canada Post. Shipping costs are calculated based on the weight, dimensions of the package, and the addresses of the Seller and Buyer.

The Seller is responsible for:

  • Generating their shipping label from their “My Sales” dashboard
  • Printing and affixing the label to the package
  • Dropping off the package at a Canada Post outlet within 7 days of the order (unless an exceptional circumstance has been reported to Bon Magasinage within 48 hours)
  • Packaging the item carefully, clean and ready to wear (packaging costs are the Seller’s responsibility)

The shipping label is included in the transaction. Shipping costs are the Buyer’s responsibility and cannot be refunded once the order has been placed.

If the Buyer has entered incorrect delivery information at the time of the order (wrong address, incorrect format, etc.), Bon Magasinage will do its best to contact Canada Post and attempt to redirect or recover the package, without being able to guarantee the outcome. In such cases, the Seller’s payment will be secured if the package is already in transit, but responsibility for the error lies with the Buyer and Bon Magasinage will not be able to issue a refund for the order.

If a Seller mixes up shipping labels and sends a package to the wrong recipient, a fixed fee of $12 per package to be reshipped will be charged to the Seller responsible for the error. This fee will be deducted directly from their Bon Magasinage virtual wallet. If the wallet balance is insufficient, the fee will be invoiced as a surplus and must be settled by the Seller before any new sale can be made on the platform.

7.1 Uncollected Packages

If a package that has arrived at a post office is not collected by the Buyer within the time allowed by Canada Post and is returned to the sender, the sale will be automatically validated by Bon Magasinage upon receipt of the returned package. Payment will be released in favour of the Seller.

A Buyer wishing to receive their package will be required to cover a fixed redelivery fee of $12 before the package is reshipped. These fees are the Buyer’s sole responsibility and cannot under any circumstances be disputed or refunded.

8. Sales Policy and Refunds

All sales made on Bon Magasinage are final. No returns or refunds are accepted. A mediation process between Seller and Buyer may be proposed by Bon Magasinage solely in the following case:

  • The item received is significantly different from its description (major undisclosed defect, missing item)

In the event of a non-conforming item, the Buyer has 48 hours after receipt to contact Bon Magasinage at allo@bonmagasinage.com. After this deadline, no claim can be processed.

In cases where an item does not suit the Buyer without valid reason, the Buyer is free to relist it directly on Bon Magasinage.

When a refund is granted, it is processed via the same payment method used for the original transaction. If payment was made through the Bon Magasinage virtual wallet, the refund will be credited to that same wallet.

Prices are set by Sellers and are final once the transaction is completed. Bon Magasinage cannot be held responsible for an item not selling or for the ineffectiveness of a listing.

8.1 Order Cancellation by the Seller

In the rare cases where a Seller is unable to fulfill an order, the Buyer will be fully refunded. Any cancellation will result in a decrease in the Seller’s fulfilled sales rate and star rating, both visible on their public Bon Magasinage profile.

9. Disputes and Mediation

In the event of a dispute between a Seller and a Buyer, Bon Magasinage will do its best to help find an amicable solution, without being held responsible for disagreements between members.

If a dispute cannot be resolved through Bon Magasinage mediation, the parties are free to pursue legal remedies available under Quebec law. These GTC are governed by the laws in force in Quebec, Canada.

10. Privacy and Personal Data Protection

10.1 Data Collected

Bon Magasinage collects the personal information necessary for the proper operation of the platform, including: first name, last name, email address, phone number, and mailing address. This information is used exclusively for the purpose of transactions and member account management.

Payment information (credit card number, etc.) is collected and managed directly by our payment processor Stripe, in accordance with their own security and privacy policies. Bon Magasinage does not have access to this data.

Certain information (name, address) may be shared between Sellers and Buyers in the context of a transaction (e.g., postal delivery). Bon Magasinage does not share any personal data with third parties for commercial purposes.

10.2 Compliance with Bill 25 (Quebec)

In accordance with the Act respecting the protection of personal information in the private sector (Bill 25), every member has the right to access, correct, and request the deletion of their personal data. To exercise these rights, please contact us at allo@bonmagasinage.com.

10.3 Account Closure

To permanently close your account, please contact us at allo@bonmagasinage.com. For legal and tax purposes, Bon Magasinage will retain the transaction history associated with your account in accordance with applicable legal obligations. Account closure does not cancel any outstanding debts owed to Bon Magasinage or its members.

11. Intellectual Property

All content on the Bon Magasinage platform (texts, images, graphics, code, brand) is the exclusive property of Bon Magasinage INC. and is protected under Canadian copyright and intellectual property laws.

Any reproduction or commercial use of this content without express authorization is strictly prohibited. Sharing for personal, non-commercial purposes is permitted.

12. Prohibited Content and Limitations

12.1 Prohibited Content

It is prohibited to publish on Bon Magasinage any content containing or referencing: drugs, tobacco, alcohol, weapons, pornographic content, offensive or obscene material. Any such content will be removed immediately and without notice. The member concerned will be solely responsible before Canadian authorities.

12.2 Counterfeits and Stolen Items

The sale of counterfeit or stolen items is strictly prohibited. If there is any doubt about the origin or authenticity of an item, Bon Magasinage reserves the right to suspend the listing and contact the Seller to obtain additional evidence. The Seller is solely responsible for the authenticity of the items they list.

12.3 Limitation of Liability

Bon Magasinage acts as an intermediary and cannot be held responsible for information provided by Sellers, for the unavailability of an item, or for any dispute between a member and a payment provider (Stripe, Wise). Bon Magasinage will do everything in its power to support its members in the event of a difficulty.

13. General Provisions

These GTC are governed by the laws of the province of Quebec and applicable federal laws of Canada. In the event of a dispute, the competent courts of Montreal, Quebec, shall have sole jurisdiction.

Should any clause of these GTC be found invalid or unenforceable by a court, the remaining clauses shall remain fully in effect. Any invalid clause will be replaced by a legally valid clause that most closely reflects the original intent.

Bon Magasinage reserves the right to amend these GTC at any time. Members will be notified of any material change by email at least 30 days before it comes into effect.
